SECURITY AND DATA PROTECTION POLICY
In accordance with the provisions of Law No. 18,331 of August 11, 2008, and Decree No. 414/009 of August 21, 2009, including their amendments and related regulations on the Protection of Personal Data, the processing of personal data carried out on the "OWNIT" platform—intellectual property of Amantani S.A.S (hereinafter "the Application")—is governed by this Security and Personal Data Protection Policy.
For these purposes, "User(s)" shall be considered any natural person who enters the Application to learn, stay informed, and invest through it.
Applicable Regulation on Personal Data
By using this Application, it is understood that the User knows, accepts, and consents that their personal data will be treated and processed by Ownit Technologies LLC, with the support of
Amantani S.A.S. as a service provider for administration and data processing, for the sole purpose of providing tools and content of the greatest utility according to the User's profile.
In this regard, data will be processed by the Application as established in Law No. 18,331 of August 11th, 2008, and its regulatory decree No. 414/2009 of August 31st, 2009.
In compliance with the aforementioned regulations, the data communicated by Users in the Application will be incorporated into the corresponding database according to the Application, for which the latter is legally responsible.
Furthermore, and also in observance of the cited regulations, the Application undertakes to adopt appropriate measures to guarantee the security and confidentiality of the personal data collected, as well as to adopt adequate security levels to prevent its alteration, loss, unauthorized consultation, or processing by third parties who may use it for purposes other than those for which it was requested.
The Application is exempt from any type of responsibility related to or resulting from the lack of truthfulness, accuracy, legitimacy, or relevance of the data provided by Users, with each User being solely responsible for any damages eventually caused as a result of the information incorporated therein.
Purpose of Personal Data Processing
The personal data collected will be used for the purpose of improving the User's experience in the Application and complying with the anti-money laundering and counter-terrorism financing (AML/CFT) regulations issued by the competent Uruguayan government entities.
Changes to this Security and Personal Data Protection Policy
The Application reserves the right to modify this Security and Personal Data Protection Policy at any time, immediately publishing the latest version following any modification.
Applicable Law and Competent Jurisdiction
Any controversy derived from the application and interpretation of this Security and Data
Protection Policy shall be subject to the jurisdiction of the ordinary judges and courts of the city of Montevideo, Oriental Republic of Uruguay.
